6A. CONFIDENTIALITY, INTEGRITY, AND PENALTIES FOR BREACH

All individuals and entities engaging with EK-Trading—whether as freelancers, vendors, partners, or collaborators—agree to operate under strict confidentiality and uphold the professional and personal integrity of all parties involved.

Any information shared through this platform, including but not limited to business concepts, customer data, pricing structures, marketing strategies, visual assets, written content, and other intellectual property, is considered confidential. This confidentiality obligation applies during and after the termination of any business relationship.

All intellectual property remains the sole property of its rightful owner or creator unless otherwise agreed in writing. Unauthorized use, duplication, distribution, or disclosure—whether in full or in part—is strictly prohibited.

In case of a breach of confidentiality, intellectual property rights, or violation of another party's professional integrity, a penalty fee of no less than EUR 10,000 shall apply, or a higher amount equivalent to the actual damage incurred—whichever is greater. EK-Trading also reserves the right to pursue additional legal remedies, including compensation for reputational harm and legal costs.

By using the EK-Trading platform or entering into collaboration, all parties confirm their understanding and acceptance of these terms.

7. LIABILITY LIMITATIONS

Dropshipping Operations:

Limited liability for supplier product quality issues
Not responsible for shipping delays beyond our control
Product warranties provided by manufacturers where applicable

Marketplace Services:

Limited liability for vendor actions or products
Vendors responsible for their own legal compliance
Dispute resolution between customers and vendors encouraged

Services:

Liability for coaching and training services is limited to the extent permitted by law. EK-Trading is not liable for indirect damages resulting from the use of such services.

General Limitations:

Liability limited to purchase price of specific products/services
No liability for indirect or consequential damages
Force majeure events exclude liability

8. DISPUTE RESOLUTION

Customer Disputes:

Initial resolution through customer service
Escalation to Swedish consumer protection agencies
Alternative dispute resolution available through EU platforms

Vendor Disputes:

Governed by separate vendor agreements
Mediation preferred before legal proceedings
Swedish law and jurisdiction apply

9. CONSUMER RIGHTS

Swedish/EU Consumer Protection:

14-day withdrawal right for distance purchases
2-year legal guarantee on products
Right to repair, replacement, or refund for defective products
Protection against unfair commercial practices

Services and Digital Products:

Customers have the right to cancel digital services, coaching, and training within the statutory withdrawal period, unless the service has commenced with the customer's consent.
Clear information about service scope, duration, and pricing must be provided prior to purchase.
All coaching materials, content, and intellectual property are protected and may not be copied or distributed without permission.
